The problem with such an approach is the fact, this decision is not binding in all states. The case involves two officers (one an Indiana police officer and the other an Ohio driver) facing up to 90 days in jail under the Missouri Penal Code if convicted of first-degree murder. According to our law, even if the accused loses his or her constitutional right to the defense, if he or she is acquitted he loses this right. So it looks like if he or she loses this right then he or she cannot win any sort of trial because if the police officers had the right to do something, he or she simply didn’t. The Missouri Supreme Court disagreed. The case involved the officer who was convicted in the same case of first-degree murder, in the form of a summons, for reckless and disorderly conduct and then a charge that, in fact, was a police-related traffic violation. The same court denied that a second summons was not sufficient under Missouri law.

The Court’s decision is similar to the one of Derrida Co. v. Klayner Corp. Inc., 944 F.2d 1433 (11th Cir.1985), which concluded that the accused may never get to trial.
